The California Bill seeks to enhance the protection of the consumer’s privacy for insurance
A new bill in California aims to increase transparency and accountability in the California insurance market by enhancing consumer privacy protection and the creation of privacy rights for insurance licenses and third -party service providers.
The Senate Bill 354, the Consumer Privatization Law for the year 2025, aims to give consumers greater control of their personal data.
Written by Senator Monic Lemon and his sponsorship by California Insurance Commissioner Ricardo Lara, SB 354 deals with privacy protection in intensive information insurance work.
The draft law authors say that SB 354 goes beyond protection under Consumer privacy laws in California, including consumer privacy law, including an expanded scope of protection, insurance companies use third -party service providers, improved notifications and disclosure, data exchange and reduction/retaining policies, data data reports, and information tools.
The personal information covered by SB 354 includes identifiers including: real name, pseudonym, postal address, unique personal identifier, online identifier, Internet protocol address, email address, social security number, driver’s license number, passport number; Biological information; Internet or other electronic network activity information; Geographical location data; No educational information available to the public; Inferences derived from consumer preferences, characteristics, personality and customs; Or any other sensitive personal information.
SB 354 will be applied to more than 400,000 insurance licenses in California and third -party service providers who treat personal information regarding insurance transactions; Inclusion of insurance transactions with consumers; Or engaging in unrelated activities related to insurance transactions that involve personal information of consumers (personal information that has been processed in insurance work, but this is not directly related to the insurance treatment that the consumer requires).
Other provisions in SB 354 include consumer:
- The right to approval by choosing to share personal information for consumers by licenses for purposes unrelated to insurance transactions;
- The right to modify, correct or delete the inaccurate personal information enjoyed by licenses about consumers (with some exceptions);
- The right to know or access the personal information categories that are processed; Categories of sources through which personal information is collected for consumers, and the identification of beneficiaries when sharing this information; Reasons for harmful subscription decisions; and
- The right to exercise consumer privacy rights free from revenge to ensure consumers obtain reasonable access to their privacy rights.
California insurance commissioner will have an enforcement body under SB 354, imposing escalation penalties against their licensees and third -party service providers in violation of the law.
